1. Introduction

These Terms of Service ("Terms") govern your use of the website piotrlitwa.com and all related services provided by Piotr Litwa ("Provider", "we", "us"). By accessing or using our services, you agree to these Terms.

2. Services

We provide GTM (Google Tag Manager) and GA4 (Google Analytics 4) monitoring, auditing, and consulting services. Services are delivered on a monthly subscription basis unless otherwise agreed.

Free GTM Audit — a one-time automated analysis of your GTM implementation, delivered via email.
Monitoring subscriptions — ongoing monthly services including GTM monitoring, GA4 monitoring, agency audit, and custom development.
Client Dashboard — access to project documentation, support tickets, and subscription management.

3. Account & Authentication

Access to the Client Dashboard requires authentication via email magic link. You are responsible for maintaining the security of your email account. We do not support password-based authentication.

4. Payments & Billing

Payments are processed by Stripe (Stripe, Inc.). We do not store your credit card information.
Subscriptions are billed monthly in advance. Prices are in EUR unless otherwise stated.
You can cancel your subscription at any time through the Stripe billing portal accessible from your Dashboard. Cancellation takes effect at the end of the current billing period.
Refunds are handled on a case-by-case basis. Contact us within 14 days of payment for refund requests.

5. Free GTM Audit

The free GTM audit tool analyzes your website's GTM implementation and sends results to the email address you provide. By using this tool, you consent to:

Your email address being stored for delivering the audit report.
Basic audit data (score, issues found) being stored for service improvement.
Optional marketing communications if you explicitly opt in.

6. Data Processing

Your data is processed through the following systems:

ELMO (CSZPiZ) — our central product and consent management system, hosted at elmo.piotrlitwa.com.
Stripe — payment processing and billing management.
Brevo — email delivery and contact management (backup).

7. Intellectual Property

All audit reports, documentation, and deliverables are provided for your internal use only. You may not redistribute, resell, or publish our reports without written permission.

8. Limitation of Liability

Our monitoring and audit services provide recommendations based on best practices. We are not liable for:

Data loss resulting from changes you or your agency make to your GTM/GA4 configuration.
Downtime or errors in third-party services (Google, Stripe, etc.).
Indirect, incidental, or consequential damages arising from the use of our services.

Our total liability is limited to the amount you paid for services in the 3 months preceding the claim.

9. Termination

Either party may terminate the service relationship at any time. Upon termination:

Active subscriptions will continue until the end of the current billing period.
Dashboard access will remain active until your subscription expires.
You may request deletion of your data at any time.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of our services after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Warsaw, Poland.
